A. RELEASE OF LIABILITY & INDEMNITY AGREEMENT

I,_____________________________________________having been advised and fully informed by Barton Brook Kennels & Animal Health Complex, hereby know as BBK, concerning the nature and purpose of the “dog park” and aware of certain risks associated with exercising dogs in a fenced-in dog park where other dogs are being exercised, on behalf of myself, my estate, my heirs, successors and assigns, do hereby release BBK, its members, officers, employees, and agents from any claims or liability for death, injury, or damages, whether to person or pet related to the use of the premises, regardless of the negligence BBK its members, officers, employees, and agents and further, I, agree to hold harmless BBK, its members, officers, employees, and agents from all liability involved in the use of the “dog park”.  I understand and recognize that numerous dogs use the dog park and that the premises include open ground that is used by other animals, both domesticated and undomesticated (wild), and therefore I and my pet may be at risk as the result of the condition of the premises and failure of other users to control their pets.

*****ALL PERSONS WHO ENTER THE PREMISES OF BBK, MUST SIGN RELEASE OF LIABILITY &INDEMNITY AGREEMENT AND AN ACKNOWLEDGEMENT OF THE RULES & REGULATIONS FOR THE DOG PARK AND DAY CARE. ANY PERSON ENTERING WITHOUT EXECUTING THE AGREEMENT AND ACKNOWLEDGEMENT WILL BE CONSIDERED A TRESPASSER AND ORDERED TO LEAVE THE PREMISES*******

B. RULES & REGULATIONS

ALL MEMBERS MUST SHOW PROOF OF CURRENT VACCINATIONS

AND PROOF THAT THEIR DOG IS SPAYED/NEUTERED.

DAYS/HOURS OF OPERATION:

• The park is open 7 days a week, year round.

• Hours of operation: Summer Hours (April 1-October 31st)

Monday-Friday 8:00am until dusk (the park will close no later than 8:30pm).

Saturday and Sunday 10:00am until 6:00pm;

Winter Hours (November 1-March 31) Monday-Friday 8:30am until 7:00pm (dusk).

Saturday and Sunday 10:00am until 6:00pm. Hours are subject to change.

WEATHER CONDITIONS:

• The park may be closed during severe weather that might be harmful to dogs and their humans

(i.e. severe temperatures and weather conditions)

All Park rules and regulations also apply to Day Care Facility Users.

Day Care Hours or Operation:  Please call ahead to reserve a space

Monday – Friday  7:00am – 7:00 pm

Saturday – 10:00am – 5:00pm

Daycare Closed Sunday’s

HAPPY, FRIENDLY DOGS ONLY PLEASE:

• Only dogs that are well-socialized will be admitted into the general park area.

• All dogs must be spayed or neutered and up-to-date on vaccinations in order to enter the park.

  Flea and tick prevention is recommended.  Negative fecal test results are required every 3 months. 

• Dogs with “dynamic personalities” that may not get along with other dogs in the general park area

   may reserve a time to exercise there dog in an enclosed area.

• 3 dogs per family are allowed per membership.

• Members and/or guests may be removed from the park at any time. Membership may be revoked at

  management’s discretion.

FOOD/SMOKING IN THE PARK:

• Food is allowed in the picnic area only.

• Smoking is permitted in designated areas only.

ID CARD/GUESTS:

• Members must present their ID card at each visit to the park. Members will not be admitted without

  a valid park ID.

• Park members may bring a total of 3 non-member dogs with their respective owners per membership

  year. Visiting guests must follow all park rules, sign a waiver/acknowledgement, and show

  vaccination/neuter/negative fecal documentation for their pet before entering the park.

• Members may bring up to 2 human guests at no charge for each visit. All guests must sign a waiver.

REFUND POLICY:

• Pro-rated annual membership fee will be refunded in the event of death or illness of a dog. Refund is

  at management discretion.

POOP PICKUP:

• Members must clean up after their own dog with bags provided by the park.

CHILDREN IN THE PARK:

• For safety sake, all children must be at least 12 years old to enter the park.

• Children must be supervised by a parent or guardian at all times. Parents must have their dog under

  voice control while supervising their child.

• Parents are not encouraged to bring their children to the park. The park is for off leash dogs and

  children may be at risk of being seriously injured.

• Children must not run, yell, climb on the agility equipment, or swim/wade in the pond/brook.

SUPERVISION:

• Dogs are to be on a leash outside the fenced areas (i.e. parking lot).

• Dogs must be supervised by their caretakers at all times.

• You must be at least 18 years old to bring a dog to the park unaccompanied by an adult.

• Members/guests must notify a park employee if a dog or person is injured in any way on the park

  premises.
